Trump’s legal team filed suit Friday against the Jan. 6 committee to block the former president from testifying on Nov. 14 — a day before he is expected to announce his intentions to run for another term — arguing that Congress does not have the authority to subpoena a president.
In a legal complaintThe US District Court in the Southern District of Florida received the file from the former president’s legal teams. They claimed that Congress can only subpoena presidents for impeachment purposes.
“But the Subpoena to President Donald J. Trump issued by the Committee does not arise from an investigation into impeachment,” the filing stated. “The Committee is unable to issue the Subpoena for the reasons described below and, in any case, President Trump does not have to comply.”
The Jan. 6 commission subpoena was described as “invalid” by the filing. It also stated that it did not further a “valid legal purpose” to compel former president’s testimony, and that other sources than Trump could provide the information. Trump’s legal team argued that the subpoena violates Trump’s executive privileges, first amendment rights, and that the request for Trump’s testimony is an excessive exercise of Congressional authority.
“Accordingly, President Trump goes to the courts to protect his rights and, in doing so, the separation of power essential to our constitution order.” filing read.
